This class explores the critical meet and confer discussions regarding Electronically Stored Information (ESI) that are now required by the Federal Rules of Civil Procedure (FRCP). Topics include evaluating ESI, implementing litigation holds, what to ask your client, what to ask other parties and how to address issues before the court. This class frames the issues and problems associated with ESI that have lead to the Amendments of the Federal Rules of Civil Procedure. Each Rule Amendment and accompanying case law will be discussed in detail, including practical tips for incorporating the new Rules into your practice.
